Good Day All,
I need a little guidance, the following issue has not come up before, I will try to keep it brief.
Currently we have a parcel that is owned by a municipality, they purchased the property on 11/2/2016 and is currently exempt. In 2021 construction began on the property to connect two existing roads with the addition of two roundabouts; the project was completed on 9/1/2021.
I was provided the real estate sales agreement which states, "the City is undertaking a road and infrastructure expansion project in order to accommodate further residential commercial development, and is acquiring the real property rights necessary to such project;"
Is there some sort of official Declaration, Ordinance or Resolution that the governing entity should file designating the land as a public right of way and providing the road a name?
Thank you for your time!
Our extensions are made official through survey/plat usually because there has to be an engineer & surveyor involved in those projects. There has been additional right of way acquired through a Right of Way deed if there is an owner other than City/County which also includes a survey. City streets have been named by filed Ordinances. Not sure that helps you but there it is.
Usually for us, any road that is created or renamed that is not designated in a plat of subdivision is updated through an ordinance or resolution assigning the name.
Thank you both for your responses! Dealing with intergovernmental issues can be touchy and I wanted to make sure I was correct in my assumption that an ordinance or resolution needed to be filed prior to continuing to pursue the matter. I appreciate your time and assistance!
